BA Mortgage, LLC held a senior mortgage on Rita Sanchez’s property. Bank of America, N.A. (Junior Mortgagee) later obtained and recorded a second mortgage on the same property. BA Mortgage initiated a foreclosure action, naming the Junior Mortgagee as a defendant. The Junior Mortgagee filed a cross-claim to foreclose its own mortgage. A default judgment was entered against Sanchez’s Estate, and the court explicitly retained jurisdiction to resolve the Junior Mortgagee’s cross-claim and determine rights to any surplus.
