Beech Aircraft Corporation (Beech) purchased non-native natural gas and injected it into a depleted underground reservoir, the Stalnaker reservoir, for storage. This reservoir extended beneath the adjoining property owned by Lowell and Aileen Anderson. Beech did not have a lease, license, permit, or any other contractual or statutory right to use the subsurface of the Andersons’ property for gas storage. Avanti Petroleum, Inc., the Andersons’ oil and gas lessee, drilled a well on the Anderson farm into the Stalnaker reservoir. It was stipulated by the parties that the gas being produced by Avanti’s well was the same gas previously injected by Beech. The Andersons and Avanti brought a quiet title action, claiming ownership of the gas produced from their land. The trial court granted partial summary judgment for the plaintiffs, holding they were entitled to produce the gas. Beech appealed. Notably, Beech was not a natural gas public utility and had not obtained a certificate from the Kansas Corporation Commission, which is the statutory prerequisite in Kansas for condemning property for underground gas storage.
