After Montana failed to submit an adequate state implementation plan under the Clean Air Act (CAA), the Environmental Protection Agency (EPA) proposed its own rule to control sulfur oxide emissions. The proposed rule, though general in form, applied almost exclusively to the Anaconda Company’s smelter, the only significant source of such pollution in the county. The EPA scheduled public, legislative-style hearings on the proposal. Anaconda demanded a formal, trial-type adjudicatory hearing with rights to subpoena and cross-examine witnesses, which the EPA refused. Anaconda also asserted that the EPA was required to file an Environmental Impact Statement (EIS) under the National Environmental Policy Act (NEPA). Before the EPA’s hearing process concluded or a final rule was promulgated, Anaconda filed suit in federal district court. The district court granted an injunction, ordering the EPA to conduct an adjudicatory hearing and prepare an EIS before proceeding. The EPA appealed.
