On February 24, 1996, the Cuban Air Force used MiG fighter jets to shoot down two unarmed, civilian Cessna aircraft operated by the humanitarian group ‘Brothers to the Rescue.’ The attack occurred without warning in international airspace over the Florida Straits. The planes were on a mission to search for Cuban rafters. Three of the four individuals killed—Armando Alejandre, Carlos Costa, and Mario De la Peña—were U.S. citizens. The personal representatives of the deceased U.S. nationals brought a wrongful death suit against the Republic of Cuba and the Cuban Air Force. At the time of the incident, the U.S. had designated Cuba as a state sponsor of terrorism. Cuba did not defend the suit, asserting a lack of jurisdiction, which resulted in a default. However, under 28 U.S.C. § 1608(e), plaintiffs were still required to present evidence satisfactory to the court to establish their claim. Plaintiffs presented evidence, including an International Civil Aviation Organization (ICAO) report, confirming the planes were in international waters when destroyed.
