The State of Alaska conducted separate undercover operations targeting two hunting guides, Douglas Vaden and Floyd Saltz, Jr., based on prior reports of illegal activity. In Vaden’s case, an undercover agent posing as a client shot and killed four foxes from Vaden’s aircraft during a closed season. Vaden provided the shotgun and maneuvered the plane to facilitate the shooting. In Saltz’s case, an agent shot a caribou on the same day he was airborne, and Saltz himself shot another. Saltz provided the rifle, pointed out the animals, and instructed the agent to waste the meat. Both guides were charged with numerous game violations, primarily on theories of accomplice liability (aiding and abetting) and transportation of illegally taken game. The defendants moved to dismiss, arguing they could not be convicted as accomplices because the agents’ acts were either not illegal or were justified. They also argued that the government’s conduct was so outrageous that it violated their due process rights.
