Eighteen defendants, including the Sheriff and Deputy Sheriff of Neshoba County, Mississippi, and a local police officer, were indicted by a federal grand jury following the murder of three civil rights workers. The indictment alleged that Deputy Sheriff Cecil Price detained the three victims in the county jail and later released them at night as part of a pre-arranged plan. The defendants then intercepted the victims, placed them in an official county vehicle, and transported them to a remote location where they were assaulted, shot, and killed. The indictment alleged this was done to “punish” the victims without due process of law. The defendants were charged with violating 18 U.S.C. § 242, for depriving individuals of constitutional rights under color of law, and 18 U.S.C. § 241, for conspiring to injure individuals in the exercise of their constitutional rights. The District Court dismissed the substantive § 242 counts against the fifteen private defendants and dismissed the § 241 conspiracy count against all eighteen defendants. The United States appealed directly to the Supreme Court.
