Case Brief Summary & Legal Analysis
tl;dr: Agents seized a man’s laptop at the border. A later, off-site forensic search revealed child pornography. The court held that while a cursory border search of a laptop is suspicionless, an intrusive forensic examination requires reasonable suspicion, which existed in this case.
Legal Significance: Establishes that the border search exception is not absolute for electronic devices. An intrusive, comprehensive forensic examination of a digital device at the border requires reasonable suspicion, distinguishing it from a routine, cursory search which remains suspicionless.
Case Facts & Court Holding
Key Facts & Case Background
Howard Cotterman was stopped at the U.S.-Mexico border after a Treasury Enforcement Communication System (TECS) alert flagged him as a sex offender potentially involved in child sex tourism, based on a 15-year-old conviction for child molestation. Agents conducted an initial, cursory search of his two laptops and digital cameras at the port of entry, finding personal photos and some password-protected files. Based on the TECS alert, Cotterman’s travel patterns, and the password-protected files, agents detained the laptops. They transported one laptop nearly 170 miles to an ICE office in Tucson for a comprehensive forensic examination. The forensic analysis, which began the next day, involved copying the hard drive and using specialized software to recover data, including from “unallocated space” where deleted files are stored. This examination uncovered numerous images of child pornography. Cotterman was subsequently indicted. The district court granted his motion to suppress, finding the forensic search required reasonable suspicion, which it concluded was lacking.
