Attique Ahmad, owner of a gas station, discovered a leak in an underground gasoline tank allowing water contamination. CTT Environmental Services informed Ahmad that the tank needed to be emptied and that self-emptying was dangerous and illegal. Ahmad subsequently rented a pump, ostensibly to remove water from his backyard. Witnesses saw Ahmad pumping gasoline into the street and a manhole. Approximately 5,220 gallons of fluid, mostly gasoline, were discharged, contaminating Possum Creek and the city sewage treatment plant, creating a significant explosion hazard. Ahmad was indicted for knowingly discharging a pollutant without a permit and knowingly operating a source in violation of pretreatment standards under the Clean Water Act (CWA). Ahmad’s defense was that he believed he was discharging water, not gasoline. The district court instructed the jury that “knowingly” applied only to the act of discharge for the CWA counts and excluded testimony supporting Ahmad’s claim that he was not present for the entire duration of the pumping, which he argued supported a theory of negligence.
