Law enforcement investigated James Spikes for drug trafficking over a four-year period. An affidavit for a search warrant on his residence detailed this history, including recent information that the residence had become his primary operational base. A confidential informant confirmed this two months prior, and just ten days before the warrant was issued, police found drug manufacturing paraphernalia in the trash outside the residence. A judge issued the warrant. During a briefing, officers were warned that Spikes might have firearms, lookouts, and police scanners. At 10:00 A.M., police arrived in a marked van. An officer used a bullhorn to announce, “Sheriff’s office, search warrant… open your door.” As the SWAT team approached the porch, they also shouted their identity and purpose. An officer knocked on the closed storm door for about four seconds before finding it unlocked and entering. The total time from the initial bullhorn announcement to entry was 15 to 30 seconds. The search uncovered crack cocaine, a handgun, and cash. At trial, the court admitted testimony about Spikes’s prior drug dealing under FRE 404(b) to show knowledge and intent. It also admitted an inculpatory statement by Spikes after finding his counsel had “opened the door” to the topic during cross-examination.
