Interstate Lead Company, Inc. (ILCO) operated a secondary lead smelting facility that purchased spent vehicle batteries. ILCO cracked the batteries, drained the acid, and reclaimed the internal lead components, known as “plates and groups.” These components were then used as feedstock in ILCO’s smelter to produce lead ingots for commercial sale. The United States Environmental Protection Agency (EPA) brought an enforcement action against ILCO for violations of federal environmental laws, including the Resource Conservation and Recovery Act (RCRA).
