Case Brief Summary & Legal Analysis

3 min read

tl;dr: A landlord was sued after a tenant’s dog bit a child. The court granted summary judgment for the landlord, finding no liability because the plaintiff failed to prove the landlord had actual knowledge of the dog’s dangerous propensities.

Legal Significance: This case establishes that for a landlord to be found negligent for injuries caused by a tenant’s animal, the plaintiff must prove the landlord had actual knowledge of the animal’s vicious propensities. A constructive knowledge, or “should have known,” standard is insufficient.

Case Facts & Court Holding

Key Facts & Case Background

Plaintiffs’ minor son was bitten by a Bullmastiff dog owned by a tenant residing in a property leased from the defendant, Wye Electric, Inc. The tenants kept several dogs on the premises. The Turnbows sued Wye Electric, the landlord, under a negligence theory. The lease agreement contained no provisions prohibiting or regulating tenants’ pets. Discovery revealed that while some of Wye Electric’s employees had been to the property and were vaguely aware that a dog was present, they did not know the specific breed of the dog that caused the injury, had never observed any aggressive behavior, and had never received any complaints about the animals. The plaintiffs could not produce any evidence showing that the landlord or its employees possessed actual knowledge of the Bullmastiff’s dangerous nature prior to the incident. The trial court granted summary judgment for Wye Electric.
