Harrah’s Vicksburg Corp. hired W.G. Yates and Sons Construction Co. to build a casino on property adjacent to land owned by C.N. Thomas and leased by his business, Surplus City, U.S.A. The construction plans required building “right up to the property line.” During construction, from July to December 1993, Yates and its subcontractors repeatedly trespassed on the Surplus City property by placing scaffolding, stacking materials, making deliveries, and swinging a crane boom over the property, which interfered with Surplus City’s business. Despite repeated requests to stop, the trespasses continued. At trial, representatives for both Harrah’s and Yates admitted the trespasses occurred and testified that, given the construction plans, the trespass was “inevitable” and “unavoidable.” The jury awarded no damages to Thomas (the owner) but awarded $3,000 in “nominal damages” to Surplus (the lessee in possession) against Yates only. The trial court refused to submit the issue of punitive damages to the jury.
