Evidence presented by the State indicated that Shock beat the child with a sycamore fishing pole and a grapevine for approximately fifteen minutes. The child did not scream but moaned, and died several days later from injuries including a fractured skull and a back ‘beaten to a jelly.’ The defense introduced evidence suggesting the child was sickly and that the head wounds were caused by a fall down stairs, denying the beating occurred on the day alleged. The deceased was the son of the defendant’s wife’s cousin and had been at the defendant’s house for about two months.
