The defendant, Paul Latraverse, was awaiting a grand jury hearing on charges of receiving stolen goods. The arresting officer in that case, Salvatore Lombardi, had acted undercover. Late one night, Lombardi was at his home when he observed Latraverse’s car pass by his house. Latraverse then parked on a nearby street with his lights off, approximately 100 feet from Lombardi’s residence. Lombardi, who had previously been threatened in connection with his undercover work, called for police backup. As the backup unit approached with its lights on, Latraverse made a U-turn and drove away from the area. When police stopped Latraverse’s vehicle, they found a can of gasoline, a rag, matches, a wire coat hanger fashioned to unlock a car door, and a handwritten note reading, “Hi, Sal, know [sic] it’s my turn asshole.” Latraverse was convicted at a bench trial of attempting to intimidate a witness. He appealed, arguing his conduct was mere preparation which he had abandoned.
