Wilma Solomon (Mother) and Lloyd Findley (Father) entered into a separation agreement during their 1976 divorce. The agreement, which was incorporated by reference into the final dissolution decree, included a provision requiring the Father to pay for their daughter Adrienne’s college education. When Adrienne reached the age of majority and enrolled in college, the Father refused to pay. The Mother first sought to enforce the provision in family court, which denied relief, ruling it lacked subject matter jurisdiction to compel support for an adult child. The Mother then filed a separate breach of contract action. The trial court dismissed this suit, applying the doctrine of merger and finding that the contractual obligation was extinguished because the corresponding provision in the decree was void for lack of jurisdiction. The court of appeals reversed, holding that the void portion of the decree did not merge. The Arizona Supreme Court granted review to reconsider its precedent in Helber v. Frazelle.
