The defendant, Olan Mills, a portrait studio company, utilized telemarketing to solicit customers. After receiving an unsolicited call, the plaintiff, S. Allen Schreiber, sent a letter to Olan Mills demanding they cease calling. The letter stated that any future telemarketing calls would be considered an acceptance of a contract for the plaintiff’s “listening services” at a rate of $100 per hour. The letter further detailed terms for late fees and collection costs. Subsequently, representatives from Olan Mills called the plaintiff on two more occasions. Believing a contract had been formed and then breached, the plaintiff invoiced Olan Mills for $479. When Olan Mills refused to pay, the plaintiff initiated a breach of contract action. The trial court granted the defendant’s preliminary objections in the nature of a demurrer, finding that no contract existed as a matter of law. The plaintiff appealed the dismissal of his complaint.
