Samuel Keller, a former starting quarterback for Arizona State University and the University of Nebraska, sued Electronic Arts (EA) for violating his right of publicity under California law. EA’s popular NCAA Football video game series featured avatars corresponding to real college players. The avatar representing Keller shared his jersey number, height, weight, physical appearance, home state, and playing style. While players’ names were omitted from the jerseys, the avatars were intended to be realistic recreations that users could control in virtual games set in realistic college stadiums. Keller alleged EA appropriated his likeness for commercial advantage without his consent. In response to Keller’s suit, EA filed a special motion to strike under California’s anti-SLAPP statute, arguing that its use of Keller’s likeness was an expressive work protected by the First Amendment. The district court denied EA’s motion, and EA appealed.
