Officer Brian Kane attempted to arrest Appellant Shawnta Robertson, who broke free and fled on foot. The chase led onto the Clay Wade Bailey Bridge. Robertson vaulted over a 32-inch concrete barrier from the roadway to a pedestrian walkway and continued fleeing. Officer Michael Partin, responding to a call for assistance, arrived in his cruiser, drove past Robertson, and stopped. Seeing this, Robertson reversed course and surrendered to Officer Kane. Meanwhile, Officer Partin exited his vehicle, vaulted the concrete barrier to join the pursuit, and fell to his death through a 41-inch-wide open space between the barrier and the walkway railing. Partin had not seen Robertson’s successful vault. Robertson was subsequently convicted of second-degree manslaughter for wantonly causing Partin’s death.
