Case Brief Summary & Legal Analysis

General Brief
4 min read

tl;dr: The decedent’s spouse challenged the parentage of an adult woman seeking to inherit from his intestate estate. The court refused to order genetic testing, holding that the ‘best interests of the child’ standard applies to adults to protect established, legally presumed parent-child relationships.

Legal Significance: This case extends the ‘best interests of the child’ standard to paternity actions involving adults, establishing that a long-standing, legal presumption of paternity can override a demand for genetic testing, even when inheritance rights are at stake. It prioritizes familial identity over biological truth.

Case Facts & Court Holding

Key Facts & Case Background

Heather Reese was born in 1971 during the marriage of her mother, Deloris, and Wade Samuel Waldschmidt, Jr. (Sam). Sam was named as the father on her birth certificate, and their subsequent divorce decree acknowledged Heather as a child of the union, ordering Sam to pay child support. Although Sam had minimal contact with Heather, she maintained relationships with his extended family and always considered him her father. Sam died intestate in 2002. Heather filed a petition to administer his estate, claiming to be his child and heir. Sam’s surviving spouse, Sandra Muret, contested Heather’s claim and filed motions in both the probate proceeding and a separate paternity action (initiated by Heather) to compel genetic testing to disprove Sam’s paternity. The district court, applying the ‘best interests of the child’ standard from In re Marriage of Ross, held a hearing and determined that ordering genetic testing was not in Heather’s best interests. Sandra appealed, arguing the Ross standard should not apply to an adult child in a dispute over inheritance.

Court Holding & Legal Precedent

Issue: Does the ‘best interests of the child’ standard, which requires a court to determine if ordering genetic testing is appropriate to rebut a legal presumption of paternity, apply to a paternity action involving an adult child whose claim is for the purpose of inheritance?

Yes. The court held that the ‘best interests of the child’ standard Lorem ipsum dolor sit amet, consectetur adipiscing elit, sed do eiusmod tempor incididunt ut labore et dolore magna aliqua.
