Plaintiff Dorris Reed purchased a house from Defendant Robert King for $76,000. King and his real estate agents knew that a woman and her four children had been murdered in the house ten years earlier but did not disclose this fact to Reed. Instead, they represented that the premises were suitable for an elderly woman living alone. King also allegedly asked a neighbor not to inform Reed of the murders. After moving in, Reed learned of the house’s history from another neighbor. Reed filed suit seeking rescission and damages, alleging that the stigma of the murders materially affected the property’s market value, making it worth only $65,000. The trial court sustained the defendants’ demurrer, concluding that a cause of action for nondisclosure required the property to be the subject of current community notoriety. Reed appealed the resulting judgment of dismissal.
