Michael Prows, a truck driver, was loading medical supplies onto his truck. The supplies were secured with large rubber bands. It was a common practice for employees, including Prows, to engage in “rubber band fights,” a custom known to supervisors who discouraged it. On the day of the incident, two co-workers flipped rubber bands at Prows while he was working. Prows retaliated. One co-worker then approached Prows with a piece of wood from a pallet. Prows took the wood, placed a rubber band between the handles of his hand truck, and attempted to launch the wood like a slingshot. The wood misfired and struck Prows in the eye, causing a severe injury. The Industrial Commission denied his workers’ compensation claim, finding the horseplay was a “complete abandonment” of his duties and therefore did not arise in the scope of his employment.
