Case Facts & Court Holding

Key Facts & Case Background

Before jury selection in Eric Presley’s criminal trial, the trial judge noticed Presley’s uncle was the only spectator. The judge ordered the uncle to leave the courtroom and the entire floor, stating there was insufficient space for the public once the 42 prospective jurors arrived. Presley’s counsel objected to the exclusion of the public. The judge maintained the decision was necessary to prevent the public from intermingling with jurors and that courtroom management was within his discretion. After his conviction, Presley moved for a new trial, presenting evidence that the courtroom could have accommodated spectators. The trial court denied the motion. The Supreme Court of Georgia affirmed, holding that the trial court had an overriding interest in preventing juror prejudice and was not required to consider alternatives to closure sua sponte; rather, the burden was on Presley to propose such alternatives.
