During plea negotiations for lewd conduct charges, prosecutor Robert Murray fabricated a confession to a more serious crime and inserted it into the English transcript of the defendant’s Spanish-language interrogation. He provided this falsified document to defense counsel, Ernest Hinman. Unaware of the fabrication, Hinman used the false confession to pressure the defendant to accept a plea. The defendant denied making the statements, and his trust in Hinman was destroyed. After Hinman discovered the fabrication nine days later, he moved to dismiss. In response, the prosecution filed a document containing an unsubstantiated claim that Hinman had admitted his client had no defense. This created a conflict of interest, forcing the Public Defender’s office to remove Hinman from the case. The defendant testified that after being confronted with the false evidence by his own attorney, he no longer trusted him.
