Defendant Evelyn Humphrey shot and killed her partner, Albert Hampton, following a long history of severe physical and psychological abuse. The abuse had escalated, and the night before the killing, Hampton shot at her with a .357 magnum revolver, narrowly missing. On the day of the killing, after more beatings, Hampton threatened her, stating, “This time, bitch, when I shoot at you, I won’t miss.” Believing Hampton was about to grab the gun to carry out the threat, Humphrey shot him. At her murder trial, the defense presented expert testimony on Battered Women’s Syndrome (BWS) to support her claim of self-defense. The expert testified that battered women become “sensitized” to their abuser’s behavior and can discern when a threat is truly life-threatening. The trial court instructed the jury that it could consider the BWS evidence to determine whether Humphrey had an actual, subjective belief in the need to defend herself, but not to evaluate the objective reasonableness of that belief. Humphrey was convicted of voluntary manslaughter.
