Richard Pears drank at a bar to the point of intoxication. He then drove recklessly, speeding and running stop signs, causing his passenger to express fear. After going to another bar and drinking more, Pears was stopped by two uniformed police officers who observed his intoxication and explicitly warned him not to drive. Pears feigned compliance, waited for the officers to leave, and then got back in his truck. He resumed his reckless driving, running multiple red lights at high speed. Shortly thereafter, Pears sped through another red light, passing cars that were stopped for it, and collided with a vehicle legally entering the intersection. The collision killed two people and seriously injured a third. A breathalyzer test and a subsequent blood test confirmed a high level of intoxication. The evidence showed Pears was repeatedly made aware of the extreme danger his driving posed, both by his passenger and by law enforcement, but chose to continue his conduct.
