Nineteen individuals, on behalf of a class of citizens in Cairo, Illinois, filed a civil rights action under 42 U.S.C. § 1983 against two state court judges. The plaintiffs alleged that in response to their civil rights activities, the defendant judges engaged in a continuous pattern and practice of unconstitutional and discriminatory conduct. These practices included setting bail according to a fixed schedule without individualized assessment, imposing harsher sentences on Black defendants than on white defendants, and unconstitutionally requiring indigent defendants to pay for jury trials in ordinance violation cases. The plaintiffs sought a federal injunction to prohibit these practices. The complaint, however, did not allege that any of the named plaintiffs were currently serving an illegal sentence, facing a pending prosecution before the defendants, or were under any immediate threat of arrest. The alleged injury was the prospect that if they were arrested for future conduct, they would be subjected to the judges’ discriminatory practices.
