Fourteen same-sex couples and two men whose same-sex partners were deceased (petitioners) filed suits in federal district courts in Ohio, Michigan, Kentucky, and Tennessee. They challenged state laws defining marriage as a union between one man and one woman. The petitioners alleged these laws violated the Fourteenth Amendment by denying them the right to marry or to have their marriages, lawfully performed in other states, fully recognized. The harms alleged were concrete and significant, including the inability to be listed as a surviving spouse on a death certificate, legal uncertainty regarding parental rights for adopted children, and the denial of legal recognition for a marriage validly performed in another state.
