Robert Nichols, driving his pickup truck, was subjected to reckless driving by Oscar Gonzalez, a truck driver for Land Transport Corp. Gonzalez repeatedly tried to pass Nichols in no-passing zones and tailgated him. In response, Nichols made an obscene gesture. When both vehicles stopped at a red light, Gonzalez exited his tractor-trailer, confronted Nichols, and attacked him with a metal cable. During the struggle, Gonzalez stabbed Nichols in the thigh with a knife.
