Pierre Valcour Miller was a co-owner in indivision of immovable property in Cameron Parish, Louisiana. The property was protected by a levee system that had fallen into disrepair, creating a risk of saltwater encroachment. Miller proposed to undertake significant repairs to the levees. Before spending any money, he filed a suit for declaratory judgment against his co-owners. He sought a judicial declaration that the proposed repairs constituted “necessary expenses” or “expenses for ordinary maintenance and repairs” under Louisiana Civil Code article 806. A declaration in his favor would establish his right to be reimbursed by the other co-owners in proportion to their ownership shares after he completed and paid for the work. The other co-owners disputed the necessity of the repairs. Most defendants filed an exception of no cause of action, arguing that because Miller had not yet incurred any expenses, he had no claim for reimbursement under Article 806.
