The case involved two separate tax deficiencies. First, in 1937, the petitioner bank acquired stock in a packing company during the liquidation of its securities affiliate. The affiliate had held the stock for sale in the ordinary course of business. The bank, legally prohibited from dealing in securities, held the stock for six years awaiting a better market before selling it in 1943 at a loss of $41,389.52, which it claimed as an ordinary loss. Second, the bank held notes from Alabama Naval Stores Company. At the direction of bank examiners, it charged these notes off as worthless in 1941 and 1943, taking corresponding ordinary loss deductions which provided a tax benefit. In 1944, the bank sold the previously written-off notes to a third party for $18,460.58. It reported this recovery as a long-term capital gain. The Commissioner of Internal Revenue determined the stock loss was a capital loss and the recovery on the notes was ordinary income, assessing deficiencies for both years.
