Case Facts & Court Holding
Key Facts & Case Background
Elizabeth Waters’ will, which granted a life estate to her cousin Lillian Young and the remainder to her granddaughter Claire Trent, was challenged by Trent on grounds of lack of testamentary capacity and undue influence. Attorney Brian P. Murphy drafted the will based on instructions from Young’s sister, without prior contact with Waters. Murphy met Waters for the first time at the will execution, where Waters, who was ill and had impaired speech and hearing, made a mark. Murphy and a hospice nurse were the subscribing witnesses. Murphy testified before the Master regarding Waters’ testamentary capacity, asserting she understood the will. Crucially, Murphy also acted as trial attorney for Waters’ estate in the contested proceedings before the Master and the Court of Chancery. Trent’s counsel had previously raised concerns about Murphy’s dual role under Del.R.Prof.C. 3.7(a), but did not file a formal disqualification motion, misinterpreting precedent on standing. The Master discounted Murphy’s testimony and recommended setting aside the will. The Court of Chancery, however, admitted the will to probate. The Supreme Court raised the issue of Murphy’s dual role sua sponte.
