A reliable confidential informant notified a St. Mary’s County Sheriff’s Deputy that respondent Kevin Darnell Dyson, a known drug dealer, was returning from New York with a large quantity of cocaine. The informant specified that Dyson would be in a rented red Toyota with a particular license plate number. The deputy confirmed the vehicle was rented to Dyson. Several hours later, when Dyson returned to the county in the specified vehicle, deputies conducted a traffic stop. Without obtaining a warrant, they searched the car and discovered 23 grams of crack cocaine in a duffel bag located in the trunk. Dyson was arrested and subsequently convicted. He challenged the conviction, arguing that because the police had ample time between receiving the tip and his return to obtain a search warrant, the warrantless search was unconstitutional. The Maryland Court of Special Appeals agreed, finding that the automobile exception required a showing of exigency which was absent here.
