In 1996, the successor railroad initiated abandonment proceedings, which were completed in 2004. The United States then filed a quiet title action against the Marvin M. Brandt Revocable Trust, the current owner of the parcel. The government claimed it had retained an implied reversionary interest in the right-of-way that became possessory upon the railroad’s abandonment.
