Plaintiff Jonathan Mannion, a photographer, created a distinctive portrait of basketball star Kevin Garnett for a magazine. Mannion directed Garnett’s pose, the concept of simple clothing with extensive jewelry, and composed the shot against a cloudy sky from a low angle with specific lighting. Defendant Coors Brewing Co.’s advertising agency, CHWA, licensed this “Garnett Photograph” to create an internal concept board for a new ad campaign. CHWA then commissioned a different photographer to produce the final billboard advertisement. The resulting “Coors Billboard” featured a different model but replicated many elements of Mannion’s original work, including the subject’s pose, white t-shirt, athletic pants, prominent jewelry, cloudy backdrop, low camera angle, and overall composition. Mannion registered his copyright in the Garnett Photograph and sued Coors and CHWA for infringement. Both parties moved for summary judgment.
