Grace Lindsay, an 88-year-old woman, slipped and fell at Zio’s Italian Kitchen. Her petition alleged the floor was wet and slick. During her deposition, Lindsay testified she did not see anything on the floor before falling but heard an unknown customer exclaim, “That floor is wet there,” immediately after. She also heard her daughter, Thelma Wissinger, who was “frantic,” state, “Well, this floor is wet.” Wissinger, in her deposition, stated she did not remember seeing anything on the floor. Zio’s manager on duty, Brad Ernst, provided an affidavit stating he examined the floor post-fall and saw no substance that could have caused it. Lindsay countered Zio’s summary judgment motion with these statements and affidavits from two former Zio’s employees. These affidavits indicated the area where Lindsay fell was routinely wet due to proximity to a kitchen opening, that warning signs were not used, and that others had previously slipped there. Zio’s challenged the admissibility of the statements and the relevance of the employee affidavits.
