Plaintiffs William and Carol Leeds hired attorney Louis Egnasko for a real estate matter. Egnasko received a teller’s check for $87,293.56 payable to the Leeds. Without authorization, Egnasko materially altered the payee line by typing “ Louis Egnasko, as attorney for “ above the Leeds’ names. He then endorsed the check and deposited it into his attorney trust account at Chase Manhattan Bank, the depository bank. Chase accepted the altered check for deposit and presented it for payment. Summit Bank, the drawer/drawee/payor bank, honored its own check. Egnasko later paid the Leeds with funds from a different trust account, but those funds were stolen from another one of his clients. The Leeds were subsequently sued in a separate action to recover those stolen funds. The Leeds then sued Chase and Summit for conversion of the original, altered check under the Uniform Commercial Code (UCC).
