Burke Construction Company, a Missouri corporation, sued Kline, an Arkansas citizen, for breach of contract in federal district court in Arkansas, based on diversity of citizenship. This was an action at law seeking only a money judgment. Subsequently, Kline instituted a suit in equity against Burke in an Arkansas state court based on the same contract, also seeking a money judgment. The issues in both cases were substantially identical. The federal action resulted in a mistrial. Burke then filed a bill in the federal court seeking to enjoin Kline from prosecuting the state court suit. Burke argued that because it had filed in federal court first, it had a right to have its case adjudicated there, and a subsequent state court judgment would render the federal proceeding futile through res judicata. The Circuit Court of Appeals granted the injunction, reasoning that Burke’s statutory right to a federal forum needed protection.
