Case Brief Summary & Legal Analysis
tl;dr: A Minnesota resident, insured under a policy centered in North Dakota, was injured in Arizona. The Minnesota Supreme Court applied North Dakota law to prevent the stacking of insurance benefits, prioritizing contractual predictability and interstate comity over Minnesota’s interest in compensating its resident.
Legal Significance: This case refines Minnesota’s choice-of-law analysis for insurance contracts, holding that predictability of results and maintenance of interstate order can outweigh the forum’s governmental interest, particularly when the facts suggest forum shopping by the plaintiff.

Case Facts & Court Holding
Key Facts & Case Background
Timothy Jepson, a Minnesota resident, purchased an automobile insurance policy from General Casualty Co. through a Minnesota agency. The policy’s named insureds included Jepson and two North Dakota corporations he owned, with a North Dakota address listed for all. The policy covered seven vehicles, six of which were registered in North Dakota and one in Indiana; none were registered in Minnesota. The premiums were calculated using lower North Dakota rates and the policy included North Dakota-specific endorsements. The policy contained an anti-stacking provision, prohibiting the aggregation of coverage limits for multiple vehicles. In 1983, Jepson was injured in a car accident in Arizona while a passenger in another person’s vehicle. He first sought and received no-fault benefits under North Dakota law. Later, in 1991, Jepson filed a declaratory judgment action in Minnesota, seeking to apply Minnesota law, which at the time of the accident would have voided the anti-stacking provision, allowing him to stack the underinsured motorist benefits for all seven vehicles. North Dakota law, in contrast, would enforce the anti-stacking provision.
