The case arose from a collision between the steamboat Wetumpka and the steamboat Magnolia on the Alabama River. The Wetumpka was on a voyage from New Orleans, Louisiana, to Montgomery, Alabama, while the Magnolia was navigating between two points within Alabama. The collision occurred in Wilcox County, Alabama, on a part of the river that was navigable from the sea but located far above the ebb and flow of the tide. The Alabama River, at the point of the collision, flows entirely within the boundaries of the State of Alabama. The owners of the Wetumpka filed a libel in admiralty in the U.S. District Court. The respondents, owners of the Magnolia, challenged the court’s jurisdiction, arguing that the tort occurred within the body of a county and above tidewater, placing it outside federal admiralty power.
