Plaintiff, International Kennel Club of Chicago, Inc. (IKC), a non-profit organization, has sponsored major dog shows under its name for over 50 years. It advertises in national publications targeted at canine enthusiasts (the “dog fancy”) and has a strong reputation within that community. While IKC does not sell products, vendors at its shows sell dog-related paraphernalia, including stuffed dogs. Defendants, Mighty Star, Inc. and DCN Industries, Inc., began marketing a line of stuffed “pedigree” toy dogs under the name “International Kennel Club.” Defendants’ marketing included a scheme where purchasers could “register” their toy dogs to receive an “official International Kennel Club membership and pedigree certificate.” Before launching the product, defendants’ counsel conducted a trademark search that revealed plaintiff’s existence but advised that use of the name was permissible due to the local scope of plaintiff’s operations and lack of direct competition. Following defendants’ national advertising campaign, plaintiff received numerous phone calls and letters from individuals confused about a potential affiliation, including inquiries about purchasing the toys and concern from a vendor about perceived competition.
