On September 13, 1992, the day the children’s maternal grandmother died, a police officer responded to the grandmother’s residence and found two of the four children there. The officer described the house as being in a “deplorable state” and the children as dirty. The officer then accompanied the mother and all four children to the parents’ residence, which he also found to be deplorable. Based on this single day’s observation of the children’s hygiene and the state of their two homes, the officer took all four children into protective custody. The Department of Human Services (DHS) filed neglect petitions the next day. The family’s only known income was a social security check. At a factfinding hearing a year later, the trial court found the children were neglected under D.C. Code § 16-2301(9)(B) and (F) based on the unsanitary living conditions. The court explicitly did not find the parents unfit due to any physical or mental incapacity. The parents argued the government failed to meet its burden because it did not prove the conditions were unrelated to their lack of financial means. The trial court rejected this argument and committed the children to DHS custody.
