A Pennsylvania statute authorized the consolidation of two cities if a majority of votes cast in the combined territory favored it, even if one city’s voters opposed. Pittsburgh petitioned for consolidation with Allegheny. In the subsequent election, a majority of total votes favored consolidation, but a majority of Allegheny voters opposed it. Pursuant to the act, the state court ordered the consolidation. Plaintiffs, citizens and taxpayers of Allegheny, challenged the act, alleging it impaired a contract between them and Allegheny (to be taxed only for Allegheny’s purposes) in violation of Article I, Section 10, and deprived them of property without due process of law under the Fourteenth Amendment by subjecting them to increased taxation from the consolidated city. The Pennsylvania Supreme Court upheld the consolidation.
