Home Telephone & Telegraph Co. sued the City of Los Angeles in federal court, seeking to enjoin the enforcement of a city ordinance that established telephone rates. The company alleged the rates were so unreasonably low as to be confiscatory, depriving it of property without due process of law in violation of the Fourteenth Amendment. The City filed a plea to the jurisdiction, arguing that if the ordinance was confiscatory, it would violate not only the U.S. Constitution but also the due process clause of the California Constitution. The City contended that an act prohibited by the state constitution could not be considered “state action” under the Fourteenth Amendment unless and until the state’s highest court had declared the act valid under state law. The federal district court agreed, reasoning it lacked power to consider the case because the alleged wrong was not truly state action until validated by a state court. It dismissed the suit for want of jurisdiction, and the company appealed to the Supreme Court.
