Case Brief Summary & Legal Analysis
tl;dr: A real estate company sued another for filing lis pendens notices on its properties. The court held that filing a lis pendens is only conditionally privileged against a tortious interference claim, meaning it is actionable if the underlying lawsuit was filed in bad faith.
Legal Significance: This case establishes for the first time in D.C. that filing a lis pendens is only conditionally, not absolutely, privileged against a tortious interference claim. It aligns D.C. with the minority Restatement view, prioritizing remedies for bad-faith litigation over unfettered access to courts.

Case Facts & Court Holding
Key Facts & Case Background
VLK, LLC and Havilah Real Property Services, LLC were rival real estate investment companies. VLK’s principal, Karen, was in a prior romantic and business relationship with Carlson, who later became involved with Havilah’s principal, Alderman. Believing Carlson and Alderman were conspiring to usurp corporate opportunities, VLK sued them and Havilah in Maryland. In connection with that lawsuit, VLK filed notices of lis pendens on 51 Havilah-owned properties in the District of Columbia. After the Maryland court found in favor of Havilah, Havilah sued VLK in D.C. for tortious interference with prospective advantage and malicious prosecution. Havilah alleged the lis pendens filings were made in bad faith, motivated by personal animus, and caused it to lose sales and suffer damages from the properties’ diminished value. The trial court granted summary judgment for VLK on the malicious prosecution claim but denied it on the tortious interference claim, finding the filings were only conditionally privileged. A jury found for Havilah on the tortious interference claim, and both parties appealed.
