In Davis v. Michigan Dept. of Treasury (1989), the Supreme Court held that states violate the doctrine of intergovernmental tax immunity by taxing federal retirement benefits while exempting state retirement benefits. In that case, the Court noted that the petitioner was entitled to a refund. Following Davis, a group of federal retirees (Harper et al.) sued the Virginia Department of Taxation for refunds of taxes paid between 1985 and 1988 under a similarly unconstitutional scheme. The Virginia Supreme Court, applying the three-part test from Chevron Oil Co. v. Huson, refused to apply the Davis ruling retroactively. It reasoned that Davis established a new principle of law and that retroactive application would cause significant inequity and hardship for the state. After the U.S. Supreme Court decided James B. Beam Distilling Co. v. Georgia and remanded Harper, the Virginia court reaffirmed its decision, arguing that Davis had not explicitly ruled on retroactivity. The U.S. Supreme Court granted certiorari again to resolve the conflict over the retroactivity of its civil decisions.
