A coalition of environmental groups petitioned the Environmental Protection Agency (EPA), requesting that it exercise its authority under the Clean Water Act (CWA) to issue new water quality standards for nitrogen and phosphorous pollution. The CWA, at 33 U.S.C. § 1313(c)(4)(B), requires the EPA to promulgate new standards if the Administrator “determines that a revised or new standard is necessary.” The EPA denied the petition, explicitly stating it was not determining whether new standards were necessary or not.
