Case Facts & Court Holding
Key Facts & Case Background
Police officers Vines and Ederington responded to a call about appellant Griffin’s overturned vehicle. A crowd had gathered. When Officer Vines inquired about the driver, Griffin stepped forward, made aggressive statements, and physically attacked Vines. As Vines attempted to defend himself, a group of young males from the crowd “swarmed” him, knocking him down. Griffin was on top of Vines, beating and kicking him, while others simultaneously kicked and struck Vines. Officer Ederington was also attacked by several individuals from the crowd when he tried to assist Vines. Vines, fearing for his life, shot Griffin, causing Griffin and the others to back away. Griffin argued there was insufficient evidence to show he knew of assistance from others or shared a common intent with them. The State contended the circumstances demonstrated a concert of action.
