Israel Garwood conveyed a parcel of real estate to James Garwood by a bona fide deed for valuable consideration. James failed to record this deed within the statutorily prescribed 15-day period. Approximately five months after the conveyance, Benjamin Garwood, a creditor of Israel, initiated a suit by writ of attachment and levied upon the same real estate. At the time of the levy, Benjamin had no notice of the prior deed to James. After the levy but before Benjamin obtained a judgment, James recorded his deed and gave Benjamin actual notice of the conveyance. Subsequently, Benjamin secured a judgment in the attachment action, and auditors conducted a sale of the property, at which Benjamin was the purchaser. A dispute arose over the proceeds from a separate partition sale of the property, with both James, the original grantee, and Benjamin, the attaching creditor and subsequent purchaser, asserting claims.
