Rhonda Fulk (mother) and Jeffery Fulk (father) divorced shortly after the birth of their infant son. The father was granted temporary custody. At the final hearing, the chancellor awarded sole custody to the father and granted the mother severely restricted visitation of one supervised hour per week at a McDonald’s, also prohibiting the maternal grandfather from having any contact with the child. Evidence at trial indicated significant issues with both parents. The mother had engaged in a same-sex affair, in which the father admitted to participating. The father had a history of drug use, with drug paraphernalia found in his home at the time of the final separation. He also had a history of violence, including an incident where he padlocked his pregnant wife inside their home and another where he was arrested for domestic violence after threatening the mother and her family with a hammer, to which he pled guilty. The mother was unemployed and living with her parents. The chancellor’s bench ruling favored the father on several factors but did not analyze every factor or provide detailed reasoning for the conclusions.
