A 6-year-old child was severely injured by a taxicab while crossing a busy street to get home from school. The New York City Police Department had voluntarily assumed the duty of assigning crossing guards to designated school crossings, including the one the child used. For the first two weeks of school, a guard was consistently present at the intersection. The child’s mother observed this and, relying on the continued presence of a guard, felt it was safe for her child to cross alone after she accepted employment. On the day of the accident, the regularly assigned guard called in sick. Police department regulations required that in such an event, a patrolman be assigned to the crossing or, if that was not possible, that the school principal be notified. The department did neither. The child attempted to cross the intersection unguarded and was struck. The jury found the city 75% liable for the child’s injuries.
